Protecting the Rights of NY Construction Workers

New York State, through the application of Labor Law §200, 240, 241 and 241-a, provides a platform to ensure that construction workers are afforded a safe work environment. While the law can do nothing to eliminate the inherent dangers of working at a construction site, it does provide a mechanism to hold those accountable who violate workplace safety rules.

Employers Have Safety Responsibilities

Labor Law §240, 241 and 241-a created a non-delegable duty on all owners, contractors, and their agents to adhere to certain safety practices and standards. While the concept of Worker’s Compensation seems self-evident to most injured workers, the prospect of a third-party claim is often not so readily apparent.

Labor Laws Cover Certain Types of Work

When involved in a construction site accident it is imperative that workers know their rights in order to better protect themselves and their families. The Labor Law applies to certain employees engaged in specific types of work. Examples of the type of activities protected are “erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure.”

The Law is Always Evolving

New York State Labor Law while simple on its face, is ever-changing, with each court decision shaping its application. To that end, it is imperative that the injured party be represented by experienced and qualified counsel to ensure they receive full and fair compensation for the harms and losses sustained on job sites.

Insurance Companies: Always Interested in Their Bottom Line

To be clear, the insurance companies behind these building projects are concerned primarily with their financial well-being, not the well-being of those working in harm’s way. To that end, insurance companies will do everything in their power to avoid responsibility, often at the expense of the injured party. As attorneys who regularly represent workers in our local trade unions we have a proven track record of success in protecting the rights of injured construction workers and maximizing their recovery.
