Motorcycle Accidents: Other Drivers or the Rider?

Schwartzapfel® Lawyers Motorcycle Accidents: Other Drivers or the Rider?

Motorcycle Accidents

Those that love to travel on their motorcycles are aware of the dangers they face each time they start their engine. However, even the harshest statistics are not enough to give riders reasons to park their bikes forever. One question that is on most drivers’ and riders’ minds is whether or not it is the rider or the vehicle that is more likely to cause an auto accident.

What the Statistics Say

There are alarming statistics regarding the dangers of motorcycle riding and potential hazards riders face each time they are on the road. Just some of these statistics include:

  • Motorcycle riders are 26 times more likely to be involved in a fatal accident – and five times more likely to suffer injuries – than a driver of a passenger vehicle.
  • In collisions with vehicles, two-thirds of those accidents were caused by the driver of the passenger vehicle – and not the rider.
  • The fatality rate for passengers and drivers of vehicles and trucks has risen higher than the number of those killed in motorcycle accidents.

Why Are Motorcycle Riders at High-Risk?

Part of the issue is attributed to the fact that motorcycles are small and vehicles have decreased recognition. These bikes are smaller visual targets, especially in a driver’s rear-view mirror or side mirror. They can easily be obscured or hidden by traffic, weather conditions and even road conditions. Intersections also pose a special risk to riders.

Vehicles making left-hand turns are one of the most dangerous situations for motorcycle riders in the United States. These collisions make up for more than 42 percent of motorcycle-car accidents. The car that is turning often strikes the motorcycle as they are going straight through the intersection, passing the turning vehicle, or attempting to take over the vehicle.

Another common cause of motorcycle accidents are road hazards. Road hazards that are inconsequential to motor vehicles can be fatal to motorcycles. These hazards include:

  • Puddles or standing water
  • Debris
  • Uneven pavement
  • Oil slicks
  • Potholes
  • Railroad tracks

Even if a motorcycle rider’s actions contribute toward the accident, in New York, the theory of comparative negligence can apply. That means that if the rider contributed to the accident, their damage can be reduced by the percentage that they contributed toward the accident.
