New York State, through the application of Labor Law §200, 240, 241 and 241-a, provides a platform to ensure that construction workers are afforded a safe work environment. While the law can do nothing to eliminate the inherent dangers of working at a construction site, it does provide a mechanism to hold those accountable who violate workplace safety rules.

Employers Have Safety Responsibilities

Labor Law §240, 241 and 241-a created a non-delegable duty on all owners, contractors, and their agents to adhere to certain safety practices and standards. While the concept of Worker’s Compensation seems self-evident to most injured workers, the prospect of a third-party claim is often not so readily apparent.

Labor Laws Cover Certain Types of Work

The Labor Law applies to certain employees engaged in specific types of work. Examples of the type of activities protected are “erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure.”
