Our experienced attorneys are dedicated to helping clients who have suffered injuries from falls on extension ladders, step ladders, and other types of ladders, regardless of the cause.

How do I know if I have a valid ladder fall accident claim?

To determine if you have a valid claim, we'll thoroughly investigate the circumstances of your ladder fall, including the type of ladder, its condition, and whether proper safety measures were in place. We'll also examine if any third parties, such as the ladder manufacturer or property owner, were negligent in causing your accident. Our team will work closely with you to assess the strength of your claim and guide you through the legal process.

What is the statute of limitations for filing a ladder fall accident lawsuit in New York?

In New York, the statute of limitations for personal injury cases, including ladder fall accidents, is typically three years from the date of the accident. However, there may be exceptions depending on the specific circumstances. It's crucial to consult with an experienced ladder fall attorney as soon as possible to ensure you don't miss any important deadlines and to preserve your right to pursue compensation.

What compensation can I expect from a ladder fall accident case?

The compensation you may receive from a ladder fall accident case depends on several factors, including the severity of your injuries, the degree of negligence involved, and your ability to work or enjoy your life after the accident. Potential damages include medical expenses, lost wages, pain and suffering, and loss of enjoyment of life. Our attorneys will diligently work to secure the maximum compensation available for your case.

Types of Construction-Related Falls

1.) Falling objects — These gravity-related accidents often involve one or more objects (e.g. debris, tools, tiles, drywall, etc.), falling on a construction worker or person below.  If this happens to you, please know: You are protected by the law!

As stated in Labor Law § 240(1): “A person employing or directing another to perform labor of any kind… on a building or structure shall furnish… devices which shall be so constructed, placed, and operated as to give proper protection to a person so employed or directed.”

Any violation of Labor Law § 240(1) that leads to injury results in the owner and contractor being absolutely liable for injuries and damages caused.  Absolute liability means that the plaintiff (the injured employee) does not have to prove negligence on the part of the defendant (the owner or contractor).  In short: What matters is that an injury occurred when it shouldn’t have, and so, even if the injured worker may have been at fault, the responsible party (i.e. the owner of the building and contractor) would still be held 100% liable.

2.) Falls from any height — These accidents occur when a construction worker falls any distance from any height at a worksite.  Regardless of whether a construction worker is working 100 feet above ground level, at ground level, or below ground level, all NYC construction workers are entitled by law to protective safety devices to keep them from falling any amount of distance.  Any injury a NYC construction worker sustains as a result of a fall from any height places absolute liability on the owner and contractor for failing to provide adequate safety devices.  Examples of safety devices include but are not limited to:

  • Safety harnesses
  • Cargo Netting
  • Fall arrest systems
  • Structurally sound scaffolding
  • Protective guardrails
  • Hard hats

Furthermore, as with falling objects, any violation of this right and the responsible party (i.e. the owner and contractor) are absolutely liable for any and all damages caused.  These include physical injuries, pain, suffering, lost wages, past and future medical costs, and any other harms or losses, regardless of whether the injured worker or employee may have been at fault.

3.) Tripping falls — These types of accidents refer to the slips, trips, and falls a construction worker may suffer as a result of unsafe conditions at a worksite.

According to New York State law, if a violation of Labor Law § 240(1) occurs and as a result a construction worker is injured on the job, then the responsible party (i.e. the building’s owner or contractor) is held absolutely liable for damages caused, and not the injured worker.

Why does seeking legal assistance matter?

Ladder fall accidents, particularly in the bustling construction sites of New York City, including Brooklyn, Manhattan, and Queens, often involve complex legal considerations. Hiring an experienced ladder accident lawyer is crucial in building a strong case. Our seasoned personal injury lawyers specialize in construction accidents and understand the intricate laws governing construction sites and worker safety.

Identifying the cause of your ladder fall is pivotal in building a strong legal case. Ladder falls can happen for a variety of reasons – maybe the ladder was faulty, maybe safety wasn’t up to snuff on the site, or maybe someone in charge dropped the ball. We know the ins and outs of the construction world and are skilled at getting to the bottom of these accidents. We don’t just take a look at the ladder itself; we chat with the people who made it and the safety pros to figure out if something was off, like not following the safety rules set by OSHA.

No two ladder fall injuries are the same, and neither are the legal details that come with them. But regardless of your situation, if you’re a construction worker dealing with injuries from a ladder fall, such as hurting your back, breaking a bone, or something else, Schwartzapfel Lawyers is here for you.

Our seasoned ladder fall injury lawyers are skilled in securing the best possible outcomes for our clients, whether through workers’ comp claims, personal injury lawsuits, or beyond. Note: Workers’ compensation benefits can cover medical bills and a portion of lost wages, but they may not fully account for the severity of serious injuries. In these cases, pursuing additional compensation through a personal injury claim may be necessary. This is because we aim for verdicts or settlements that truly reflect the impact of your injuries.

To start recovering today, call Schwartzapfel Lawyers at 516-342-2200 and allow us the honor and privilege of fighting — and winning! — for you.

What is the role of workers’ compensation in a ladder accident case?

If your ladder fall occurred on a construction site in New York, workers’ compensation benefits might be available to you. These benefits can cover medical bills, a portion of your lost wages, and other related expenses. Here, it’s important to note that workers’ compensation claims are not fault-based. This means that you may be entitled to benefits regardless of who was at fault for the accident.

At Schwartzapfel Lawyers, we have more than (150) years of combined experience in successfully handling workers’ compensation claims and are ready and eager to help with yours.

What are your legal rights during a ladder fall accident?

In New York City, the construction industry is governed by specific safety regulations. Occupational Safety and Health Administration (OSHA) guidelines mandate certain safety standards for ladder use. If these standards were violated, leading to your accident, you might have a strong personal injury case. Our lawyers are well-versed in OSHA regulations and can help determine if any violations contributed to your accident.
