Advocating for Bikers’ Rights to Safely Share the Road

Riding a motorcycle is exhilarating and expansive. Not to mention you have a much better chance of finding a parking spot for a motorcycle in New York City instead of your car. Before you buy a bike, however, you should feel confident in your ability to ride safely and be prepared to obtain the appropriate New York driver’s license classification. Even motorcyclists with years of experience benefit from taking classes with professional instructors to decrease the likelihood of being hit by an inattentive driver or defective roads.

NYC personal injury law firm Schwartzapfel Lawyers P.C. has been advocating for bikers’ rights for over 30 years. Our New York City motorcycle crash attorneys care about your safety and provide you with helpful information so you can avoid injuries while enjoying your motorcycling experience.

DMV Process for Getting an M or MJ Endorsement

You are required to have the proper license endorsement to legally operate a motorcycle in New York. The M endorsement on your license allows you to drive a motorcycle. If you are younger than 17, your license will carry the MJ endorsement.

To obtain this class of license, you should:

  • Study the motorcycle manual to prepare for your written test
  • Schedule an appointment at the NY Department of Motor Vehicles
  • Pass the written test to obtain your learner’s permit
  • Either take a qualified two-day riding course or schedule and pass your road test at the DMV

Riders who are classified as MJ are subject to junior license restrictions. Motorcyclists as young as 17 years old can obtain M classification if they present a Student Certificate of Completion. Otherwise, riders must be 18 years old to obtain the M endorsement.

Waiver to the DMV Motorcycle Road Test

You may not have to take a road test if you meet the waiver requirements, including:

  • Valid New York State license
  • Valid motorcycle learner’s permit
  • NYS Motorcycle Safety Foundation card that proves you completed the Basic Rider Course (BRC) or a Basic Rider Course 2 License/Waiver (BRC2-LW) within the last two years

If you are visiting from out-of-state, you are permitted to ride your motorcycle in New York with the appropriate credentials from your state. If you have moved here, you must exchange your out-of-state motorcycle license for a New York motorcycle license.

Why Our Attorneys Recommend Taking a Riding Course

A riding course can help you stay safe and avoid being injured by inattentive and careless drivers as well as dangerous and defective roads and highways. Even if you know how to ride a motorcycle, qualified instructors at a riding course teach you, or remind you, crucial safety measures. The course offers supervised riding experience before you take your bike onto New York City’s congested roadways. You not only learn how to avoid making crucial errors, but also to avoid accidents caused by negligent motorists.
