Workplace Injuries

Workplace injuries hurt thousands of New Yorkers each year. In 2007, the state Workers’ Compensation Board reported 139,250 new cases involving workers injured on the job. Unfortunately, many injured workers failed to collect all of their medical and financial benefits because they wrongfully believed that they didn’t need an attorney. The insurance companies have attorneys protecting their rights, and so should you.
If you’ve been injured on the job or fallen ill because of your job, you are entitled to workers’ compensation benefits that will help cover your medical bills and your lost wages. Some of the most common causes of workplace injuries include:
- Construction accidents;
- Slip and fall accidents;
- Car accidents;
- Truck accidents;
- Exposure to harmful substances;
- Dangerous equipment;
- Fires and explosions;
- Workplace violence.
Nearly all workers are covered under New York workers’ compensation, which provides medical and wage benefits for a job-related injury or illness. However, the process to apply for and receive workers’ compensation can be frustrating and confusing. Many workers’ compensation claims are initially denied – and without well-qualified and experienced workers’ compensation attorneys, you can lose the financial and medical benefits to which you are entitled.
At Schwartzapfel Partners P.C., our attorneys and staff have extensive experience with the New York workers’ compensation system. We can help you and your family:
- Collect benefits for lost wages;
- Collect benefits, such as Schedule Loss Awards;
- Collect benefits for a permanent loss of use or permanent disability.
Our Website has answers to many of the frequently asked questions about workers’ compensation, including:
- What types of workers’ compensation benefits can be awarded to you and your family?

If your workplace injury was caused by someone other than your employer or co-employee, such as the owner, general contractor or subcontractor, you may be eligible to file a lawsuit and collect money in addition to workers’ compensation benefits. Call us. We can help you.
In New York State any person injured on the job, with a few exceptions, is covered by workers’ compensation insurance. The employer, by law, is required to provide workers’ compensation insurance. As a result of the law requiring employers to carry workers’ compensation insurance, an employee is prohibited from suing his employer or co-employee, with few exceptions. Unlike a personal injury case, it doesn’t matter how the accident occurred or who caused it. Even if it was the worker’s own fault or carelessness that caused his or her injuries, the injured worker is entitled to workers’ compensation benefits.
Workers compensation benefits include, but are not limited to: payment of medical bills, a portion of lost wages, scheduled awards for permanent loss of use or disability of a body part or facial scarring.
Workers’ compensation does not provide one cent—nothing—for an injured worker’s pain or suffering.
Fortunately, in most cases, you do not have to settle just for workers’ compensation benefits. Often, an injured worker can recover workers’ compensation benefits and file a personal injury lawsuit. If your injury was caused by someone other than your employer or a co-employee, you can recover additional money, including money for your past and future pain and suffering and economic loss, lost wages, lost pensions, loss of vacation funds, loss of Social Security income, loss of health insurance costs and loss of household help. Other parties that may be legally responsible for these payments may include owners, landlords, general contractors, managers, subcontractors, etc.
There are special laws in New York State that protect workers. Let us investigate and determine who may be legally responsible for your accident. Don’t just settle for workers’ compensation benefits.
