Who is at Fault?
As a result of design and manufacturing defects, tire and tread separations have become the most common type of failure of steel belted radial tires. The most disturbing detail, however, is that the manufacturers knew about the defects, but did nothing to correct them until the casualties began to pile up.
Firestone's ATX and Wilderness tires, Goodyear Range E tires, Wrangler LT tires and Dunlop Grandtrek tires have been recalled by the millions. Additionally, other companies such as General, Cooper and Uniroyal-Goodrich have all been investigated by the National Highway Traffic Safety Administration.
Most consumers do not understand the causes of tire failure, and the literature produced by manufacturers, conveniently enough, avoids mentioning potential risks. Traditionally, the tire industry has attempted to shift the burden of defective tires to the victim in the accident, saying that tread separations are the result of impact damage or under inflation. What these companies won't tell you is that car manufacturers actually suggest lower tire pressure for a smoother ride. Ultimately, the reason for widespread tread failure is due to design and manufacturing defects and not because of something for which the individual consumer is responsible.
The technology needed to build tires without a steel belt has existed for years, but because of an increase in production costs of up one dollar per tire, the industry has decided to ignore this option. However, due to national recalls of millions of commercial tires, this issue is beginning to receive more attention.
If you have been involved in an accident due to tire failure, it is essential that you preserve the defective tire and any additional evidence. If you can see an exposed wire, chances are that the tire was not manufactured properly. Please call us at 800-966-4999 to speak to one of our qualified lawyers.
