Rochester to dismiss Premier from litigation

BANGALORE (Reuters) - Rochester Medical Corp. on Monday said it has reached a settlement agreement to dismiss Premier Inc. and Premier Purchasing Partners L.P. from a litigation it filed on March 16, 2004.

Premier will pay Rochester a total of about $8.8 million which will be reflected in the company's current quarter, the maker of medical catheters said in a statement. It said Premier has been dismissed from the litigation with prejudice.

The litigation will continue against all other defendants including C.R. Bard Inc., Tyco International Ltd. Tyco Healthcare Group LP, Novation LLC and VHA Inc., in the case scheduled for trial in May 2007.
